BACKGROUND:

As part of the Theodore Street widening and improvement project, the City is obligated to install a shared use path along River Road extending from Riviera Boulevard to the south City Limits and along Riviera Boulevard from River Road to Eagle Ridge Park in order to meet IDOT’s complete street policy.  Complete streets guidelines require that bicycle and pedestrian ways be considered as part of the planning and development of transportation facilities.  A permanent easement will be utilized to install part of the shared use path along Riviera Boulevard at Lot 1 of Eagle Ridge sub-division Unit 2 (commonly known as 1314 Major Drive).  Donald L. Reese and Tamera A. Reese, the owners, are granting a 10-foot public utility, drainage, sidewalk, and landscaping easement located north of the right-of-way of Riviera Boulevard along 1314 Major Drive.  This matter will be reviewed at the July 15, 2024 Public Service Committee Meeting.

 

CONCLUSION:

An agreement has been reached with Donald L Reese and Tamera A. Reese, for the negotiated value of $300.00 for the permanent easement.

 

Sufficient funds exist utilizing the General Fund Public Works Engineering & Construction Fund / Professional Services (Org 09027000, Object 524300, $300.00).

 

The attached resolution accepts the public utility, drainage, sidewalk, and landscaping easement.  It is in the best interest of the City to accept the permanent easement.

Based on the above, it is recommended that the Mayor and City Council adopt the attached Resolution accepting the grant of a public utility, drainage, sidewalk and landscaping easement from Donald L. Reese and Tamera A. Reese at Lot 1 of Eagle Ridge Sub-division Unit 2 along Riviera Boulevard.
