Resolution Approving a Facility Encroachment Agreement with CSX Transportation Inc. Related to the Railroad Street 2025 Water Main Improvement Project

BACKGROUND:
On Tuesday, January 21, 2025, the contract for the Railroad Street Water Main Improvement Project was awarded to PT Ferro Construction Co. Included in the scope of work for this project is the installation of new water main under the CSX railroad tracks at the location of Jasper St. and Railroad St. (Route 6). CSX, doing business as CSX Transportation, Inc., requires a Facility Encroachment Agreement between the City and CSX Transportation Inc. to allow construction and future operation and maintenance of the water main in the CSX right of way. The work is scheduled to be constructed in 2025. The Public Service Committee will review this matter.
CONCLUSION:
Staff applied for the facility encroachment agreement with CSX Transportation Inc. CSX Transportation Inc. provided the attached Facility Encroachment Agreement which provides for similar terms and conditions of prior agreements. The agreement requires payment by the City of a one-time fee of $5,100.00.
Funds will be charged to the Water Main Replacement Fund (Org 53880000, Object 557200, $5,100.00)

Based on the above, it is recommended that the Mayor and City Council take the following actions:
1. Approve the resolution approving the Facility Encroachment Agreement with CSX Transportation Inc.
2. Direct the City Manager and City Clerk to execute the attached Agreement on behalf of the City of Joliet and pay any related fees required by the Agreement.
