Resolution Approving a License Agreement Between the City of Joliet and 311 Ottawa Building LLC for the Use of a City Owned Parking Facility

BACKGROUND:

The property located at 311 N. Ottawa Street is currently undergoing renovations for use as an apartment building.  There is currently limited parking available for tenants of the building.  There is currently a City owned parking facility (PIN 30-07-09-423-005-0000, commonly known as the Riverwall Parking Facility) located near this building that receives little usage.  The owner of the 311 Ottawa Building LLC has requested use of the City’s parking facility.

 

The Public Service Committee will review this matter.

 

CONCLUSION:

The City is proposing a License Agreement granting 311 Ottawa Building LLC the exclusive right to use the Parking Lot for a term of two years, with automatic renewals for successive one-year terms unless terminated by either party with a 30-day written notice.  In lieu of rent, the Licensee agrees to improve the Parking Lot with an asphalt overlay, pavement marking, parking lot lighting, and landscaping improvements.  These improvements must be completed before the Licensee can use the Parking Lot.

 

The Licensee will also be responsible for the maintenance and upkeep of the Parking Lot during the term of the agreement, including regular cleaning, repair of damages, upkeep of lighting, pavement marking, snow removal, and landscaping.  Additionally, the Licensee will maintain comprehensive general liability insurance and indemnify the City against any claims arising from the use of the Parking Lot.

 

This agreement is beneficial for the City as it ensures the Parking Lot is maintained and improved at no cost to the City while holding the property for future development.

Based on the above, it is recommended that the Mayor and City Council approve the resolution authorizing the City Manager to execute the License Agreement between the City of Joliet and 311 Ottawa Building LLC for the use of a City Owned Parking Facility.
