BACKGROUND:

The petitioner, All in Campus, LLC, is requesting approval of the Final and Recording Plats for Cadence Crossings, Unit 1 Subdivision. The subject property is a 34-acre portion of the greater, 70-acre, Cadence Crossings Subdivision Preliminary Plat. In 2021, the City Council approved the preliminary plat for the greater 70-acre development area. The City also approved annexation and zoning reclassification to its present I-1 (Light Industrial) zoning designation at this time. Lastly, a Special Use Permit for truck and trailer parking, freight cartage, truck repair facilities, and the sale of new and used trucks and trailers was approved simultaneously with the preliminary plat, annexation, and rezoning in 2021.

 

At the November 7, 2023, meeting of the City Council, the petitioner, All in Campus, LLC, received approval to construct a temporary truck and trailer parking lot for approximately 350 trailers or tractor/trailers on the southerly 10 acres of Lot 1 of the preliminary plat of the Cadence Crossings Subdivision, otherwise known as the “Interim Marshalling Area.” The temporary approval would allow site access from Marcella Avenue. Temporary use for the Interim Marshalling Area will expire nine months after the completion of (i) the Chicago Street/Emerald Drive intersection improvements, (ii) the improvement of Emerald Drive between Chicago Street and Marcella Avenue, and (iii) intersection improvements to the east half of the Emerald Drive/Marcella Avenue intersection. Once these completions have been made, road improvements, utility extensions, and other public improvements will be required, per the amended annexation agreement. Removal of the temporary status on the marshalling yard will also allow for the location of an additional 366 tractor trailer stalls on Lot 1, per the originally approved Special Use Permit from 2021.

 

Right-of-way dedications are needed to extend Emerald Drive from Route 53 to Lot 1 of the Cadence Crossings Subdivision. Since the adjoining properties are under different ownership, these dedications have not yet been made. This discrepancy is the primary reason the preliminary plat was approved for a three-year extension in January of 2024. Staff has agreed to allow access to the interim marshalling yard via Laraway Road and Marcella Avenue until the necessary dedications to extend Emerald Drive can be made. The subject final and recording plats will finalize the lot configuration for Lots 1, 2, and 3, and location of utilities and easements that are necessary for the greater site’s stormwater detention and provision of site utilities. Approval of the Unit 1 Final and Recording Plats will allow the petitioner to proceed with plans for subsequent Units of the subdivision, which would include a 253,200 square foot “Pit Stop” facility that includes a 7-bay truck and trailer repair operation, new and used truck and trailers sales, parts storage, and restaurant, in addition to a multi-tenant 114,308 square foot warehouse. A Special Use Permit to allow these uses was approved by the City Council on December 21, 2021. 

 

PLAN COMMISSION PUBLIC HEARING:

The Plan Commission held a public hearing on the Final Plat for Cadence Crossings, Unit 1 at its June 19, 2025, meeting. Robert Gilbert with Jacob & Heffner Associated appeared on behalf of the petition. No members of the public spoke in favor of or in opposition to the petition. Minutes of the meeting are attached hereto.

 

RECOMMENDATION OF THE PLAN COMMISSION:

Jason Cox moved that the Plan Commission recommend approval of the Final Plat of Cadence Crossings, Unit 1 Subdivision. Brigette Roehr seconded the motion, which passed with seven (7) aye votes. Voting aye were Cox, Crompton, Eulitz, Kella, Radakovich, Roehr, and Turk. Commissioners Martin and Perez were absent.

RECOMMENDATION OF THE ADMINISTRATION:

Staff concurs with the recommendation of the Plan Commission and recommends that the Mayor and City Council approve the following:

 

1.                     Ordinance Approving the Final Plat of Cadence Crossings, Unit 1 Subdivision (FP-2-25).

 

2.                     Ordinance Approving the Recording Plat for Cadence Crossings Unit 1 Subdivision (RP-6-25), subject to the receipt of the following fees and documentation:

a.                     A performance bond or letter of credit for public improvements; 

b.                     A one and one-quarter percent (1 ¼%) inspection fee for public improvements;

c.                     An irrevocable offer of dedication for public improvements;

d.                     An engineering review fee as determined by City staff.
