BACKGROUND:
The petitioner, Northern Builders, is requesting approval of the Final and Recording Plats of Cherry Hill Business Park West Unit 6 Subdivision, Phase 2, which is located near the NEC of Cherry Hill Road and Spencer Road. The approval will plat the remaining lots from the previously approved preliminary plat and will permit the future development of a cold-storage facility on Lot 3. The subject property received a variation from the City’s Zoning Board of Appeals in January of 2023 to allow double-deep trailer parking that is shown on the proposed site plan for Lot 3. The total subject area is approximately 71 acres in size. Lot 3 is located to the north of Spencer Road, within the southern portion of the Unit 6 site. Lot 3 would be approximately 23.6 acres in size and contain a 358,759 cold storage building. The site would eventually feature 103 truck trailer stalls and 118 car parking spaces. Lots 2 through 4 are buildable lots that range in size from 11.3 acres to 24.1 acres.
The subject property was annexed into the City and zoned to its existing zoning designation of I-1 (Light Industrial) in April of 2005. The property is a part of the preliminary plat for the Cherry Hill Business Park West Unit 6 subdivision, which was originally platted to include four lots for future light industrial use, with two outlots for stormwater detention. A recording plat for Phase One of the subdivision, which recorded Lot 1 to the south of Ellis Road, and Outlot A for stormwater detention and compensatory storage, was approved in September of 2021.
A 30 ft.-wide landscape buffer would be located along the north side of the Spencer Road frontage. A 40 ft.-wide setback which would include a 20 ft.-wide public utility and landscape easement would separate any future development between Lot 2 and Ellis Road. Each landscape buffer area will contain berming and installation of landscaping per Section 47-15E.5 of the City’s Zoning Ordinance. Each future lot would be required to connect to City water and sanitary sewer upon future development. Water and sewer connection fees and development impact fees will be required. Future development must comply with all requirements pursuant to the City’s Zoning Ordinance, Non-Residential Design Standards, Landscaping and Screening Regulations, and Unified Tree Ordinance.
An existing single-family residence is located just west of the proposed cold storage facility site within Lot 3 on the north side of Spencer Road. The developer is currently engaged in discussions with the property owner about acquisition of this property to include in the subject subdivision.
The subject property is zoned for I-1 (Light Industrial) use and the proposed cold storage facility use on Lot 3 is allowed as-of-right within this zone. Approval of the final plat will allow for future development on Lots 2, 3, and 4 of the Cherry Hill Business Park West Unit 6 Subdivision.
