Resolution Accepting a Temporary Traffic Signal License Agreement with North Windham Properties, LLC at 1444 N. Larkin Avenue for the Larkin Avenue Water Main Improvements Project

BACKGROUND:
As part of the Larkin Avenue Water Main Replacement project, the installation of a temporary traffic signal pole & guy wires on the private property at 1444 N, Larkin Ave (the Portillo’s property) is required for maintenance of traffic at this intersection during construction.
The Public Service Committee will review this matter.
CONCLUSION:
The Temporary Traffic Signal License Agreement with North Windham Properties, LLC establishes the terms under which the City may access the designated portion of the property, defined as the “Licensed Area,” solely for the completion of the required traffic signal work. The agreement specifies that all costs, expenses, and liabilities associated with the installation, maintenance, operation, and removal of the temporary signal equipment will be borne exclusively by the City. It also requires the City to indemnify and hold harmless North Windham Properties and its related parties against claims connected to the work, except where such claims arise from the licensor’s gross negligence or willful misconduct.
There is no cost for this license agreement, and the term of the license extends until completion of the work.

Based on the above, it is recommended that the Mayor and City Council approve the attached Resolution accepting a license agreement from North Windham Properties, LLC for the installation of a temporary traffic signal pole and associated equipment at 1444 N. Larkin Avenue for the Larkin Avenue Water Main Improvements Project.
