Resolution Approving an Easement Agreement with Commonwealth Edison Company (“ComEd”) for Utility Facilities Across City-owned Property (PIN 09-01-400-007)

BACKGROUND:
Commonwealth Edison Company (“ComEd”) is seeking an Easement Agreement between the City of Joliet and ComEd for City-owned property in Seward Township, Kendall County (PIN 09-01-400-007). ComEd seeks limited, nonexclusive rights to install and maintain electrical and related utility infrastructure across a defined portion of this parcel.
The Public Service Committee will review this matter.
CONCLUSION:
The agreement grants ComEd authority to construct, operate, maintain, replace, and relocate poles, cables, conduits, transformers, and associated equipment, subject to City permits, engineering standards, and a requirement to provide 30 days’ written notice before non-emergency work. ComEd must cover all costs for City-required protective measures. The easement includes indemnification provisions and requires ComEd to maintain liability insurance naming the City as an additional insured, with these obligations running with the land. The City retains the ability to require relocation or removal of facilities for public projects and may terminate the easement if future governmental use becomes incompatible with utility operations.
