Ordinance Approving a Plat of Vacation for a 3.788-Acre Drainage and City Utility Easement Along the Former Bridge Road Right-of-Way South of Gladys Avenue and North of Noel Road

BACKGROUND:

The subject Plat of Vacation covers approximately 3.788 acres of land that was previously vacated as public roadway in 2022 to allow construction of the first phase of the East Gate Logistics industrial development. During the time of the vacation, the property owner, petitioner, and developer, TCIH Land Holdings, LLC, did not record the mylar plat for the underlying vacation of a Public Utility and Drainage easement, thereby leaving the easement in place. The petitioner is now interested in recording the subject Plat of Vacation to remove the underlying easement. The land has since been developed with the extension of Third Coast Parkway and construction of two industrial warehouse buildings over and adjacent to the vacated former right-of-way.

 

Within the last month, the petitioner has obtained signatures from NICOR, AT&T, and ComEd for a companion Plat of Vacation for private utilities that will also be recorded by the petitioner. The City’s Public Works and Public Utilities Departments are not opposed to the requested easement vacation.

 

 

CONCLUSION:

Approval of the subject Plat of Vacation will formally remove the existing Public Utility and Drainage easement where the right-of-way was vacated in 2022.

Staff recommends the Mayor and City Council approve the Ordinance approving a Plat of Vacation for Drainage and City Utilities Along the Fromer Bridge Road Right-of-Way  South of Gladys Avenue and North of Noel Road.
