Resolution Approving a Memorandum of Agreement between the City of Joliet and the Illinois EPA for the Property Located at 14 W. Clinton Street

BACKGROUND:

An underground storage tank (UST) located in the Clinton Street right-of-way was encountered during the construction of Joliet City Square.  The tank was removed and disposed of in accordance with IEPA requirements and permitting.  In order to complete the process for the letter of No Further Remediation from IEPA it will be necessary to enter into a Memorandum of Understanding.

 

The Public Service Committee will review this matter.

 

CONCLUSION:

The Administration is requesting approval of the attached Memorandum of Agreement which requires the City to complete several actions should this portion of the Clinton Street right-of-way be transferred to another party through conveyance or jurisdictional transfer.  Required actions include:

                     

                     Notification of the intended transfer to IEPA

                     Providing IEPA with copies of deeds of the property as well as recorded land use limitations

                     Making arrangements to ensure that any transferred property is subject to land use limitations required by the corrective action plan for tank removal and No Further Remediation letter

Based on the above, it is recommended that the Mayor and City Council approve the attached Memorandum of Agreement regarding the removal of the UST located at 14 W. Clinton Street.
